Welcome to Ocean's Haven. These Terms & Conditions govern your use of OceansHaven.org and purchases made through the Ocean's Haven store. By accessing this website, purchasing a product, or using our services, you agree to these Terms & Conditions.
PRODUCTS
Ocean's Haven offers both physical merchandise and digital products.
Physical merchandise may include clothing, mugs, printed artwork, pictures, accessories, and other made-to-order products. Certain physical products are produced and fulfilled by third-party print-on-demand fulfillment providers.
Digital products may include workbooks, books, guides, worksheets, downloadable materials, meditation content, audio products, courses, and other electronically delivered materials.
Product availability, designs, pricing, descriptions, and specifications may change without notice.
MADE-TO-ORDER PHYSICAL PRODUCTS
Certain clothing, mugs, printed artwork, pictures, and other merchandise are made specifically for you after your order is placed.
Because these products are made to order, customers are responsible for carefully reviewing product selections, including size, color, quantity, design, shipping address, and other available options before completing a purchase.
Production may begin shortly after an order is submitted. Once fulfillment has begun, changes or cancellations may not be possible.
Returns, refunds, replacements, and exchanges for physical merchandise are governed by the Ocean's Haven Refund & Return Policy.
DIGITAL PRODUCTS
Digital workbooks, books, guides, worksheets, audio products, meditation materials, courses, and other downloadable or electronically delivered products are licensed to the purchaser for personal use unless otherwise expressly stated.
Purchasing a digital product does not transfer ownership of the intellectual property contained within that product.
Digital products may not be copied, reproduced, redistributed, resold, uploaded, shared, published, modified for resale, or otherwise commercially exploited without written authorization from Ocean's Haven or the applicable rights holder.
Refunds for digital products are governed by the Ocean's Haven Refund & Return Policy.
PRICING AND PAYMENT
All prices are displayed in U.S. dollars unless otherwise stated.
Payment is due at the time an order is placed. Applicable taxes and other charges may be calculated during checkout where required.
Ocean's Haven reserves the right to change prices, promotions, discounts, or product availability at any time. Price changes will not affect completed purchases that have already been paid for.
If a pricing or product-listing error occurs, Ocean's Haven reserves the right to correct the error and, where legally permitted, cancel or refund an affected order.
SHIPPING
Shipping terms apply only to physical merchandise.
Shipping methods, costs, and estimated delivery times may vary depending on the product and destination.
Where Ocean's Haven advertises free shipping, the offer applies only to the geographic region, products, and shipping method identified in that offer. Free shipping does not necessarily include expedited shipping, international shipping, customs charges, duties, or other fees.
Production and delivery dates are estimates and are not guaranteed.
Ocean's Haven is not responsible for carrier delays, customs delays, severe weather, natural disasters, incorrect customer addresses, or other circumstances outside our reasonable control.
International customers may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by their country or local authorities.
ORDER INFORMATION
Customers are responsible for providing accurate billing, shipping, contact, and order information.
If you discover an error after submitting an order, contact Ocean's Haven as soon as possible. We will make reasonable efforts to assist, but changes cannot be guaranteed once a made-to-order product has entered production.
THIRD-PARTY FULFILLMENT
Ocean's Haven may use third-party companies, including print-on-demand providers, shipping carriers, payment processors, website providers, and other service providers to process and fulfill purchases.
Information necessary to complete an order may be shared with these providers as described in the Ocean's Haven Privacy Policy.
Customers purchasing from OceansHaven.org are purchasing from Ocean's Haven. Questions or concerns regarding an Ocean's Haven order should therefore be directed to Ocean's Haven rather than our manufacturing or fulfillment providers.
PRODUCT APPEARANCE
We make reasonable efforts to display product designs and colors accurately. However, colors may appear differently depending on a customer's device, screen settings, manufacturing process, printing method, materials, or other production variables.
Minor variations that are normal to the manufacturing or printing process may occur.
A genuine printing defect, manufacturing defect, damaged item, or incorrect item is handled according to our Refund & Return Policy.
INTELLECTUAL PROPERTY, QUOTES & ORIGINAL CONTENT
Unless otherwise stated, original content created, authored, published, or sold by Ocean's Haven, Bianca Ocean Desmore, and/or Ocean~Spirithealer—including written quotes, original sayings, articles, books, workbooks, educational materials, graphics, artwork, photographs, designs, apparel designs, lyrics, audio content, course materials, assessments, program materials, logos, slogans, product names, and other creative works—is protected by applicable intellectual-property laws.
Purchasing a product containing Ocean's Haven content does not transfer ownership of the underlying quote, artwork, design, written material, or other intellectual property to the purchaser.
PERSONAL SOCIAL MEDIA SHARING OF QUOTES
Original quotes and sayings may be shared on personal social media accounts only when proper credit is given to the original author.
When sharing a quote authored by Bianca Ocean Desmore and/or Ocean~Spirithealer, the author's name or original attribution must remain clearly visible or be included with the post. Existing signatures, watermarks, attribution, copyright notices, or identifying marks may not be intentionally removed, cropped out, covered, altered, or replaced in a manner that makes the work appear to have been created by someone else.
Sharing an attributed quote for personal, noncommercial purposes does not grant ownership of the quote or permission to commercially exploit it.
PROHIBITED USE OF QUOTES AND CONTENT
Without prior written permission, Ocean's Haven content may not be:
Printed on T-shirts, mugs, posters, books, journals, workbooks, greeting cards, stickers, digital downloads, or other merchandise for resale;
Used to create products for sale through print-on-demand services or marketplaces;
Sold, licensed, sublicensed, repackaged, or redistributed;
Included in another person's book, workbook, course, paid membership, subscription, coaching program, commercial website, advertising campaign, or other commercial product;
Used in social media content without clearly identifying the original author;
Presented, rewritten, reformatted, or visually redesigned in a manner that falsely suggests the quote or underlying work was created by someone else;
Used to train, create, market, or sell derivative commercial products based substantially upon protected Ocean's Haven materials;
Used commercially simply because the content was publicly available on OceansHaven.org or an Ocean's Haven social media account.
Credit does not equal commercial permission. Crediting Bianca Ocean Desmore, Ocean~Spirithealer, or Ocean's Haven does not give another person or business permission to place the work on merchandise, incorporate it into products for sale, or otherwise profit from it.
REPOSTING GRAPHICS AND IMAGES
Original Ocean's Haven social media graphics may be reposted for personal, noncommercial sharing when the graphic is kept substantially intact, and the original attribution remains visible.
Graphics may not be altered to remove attribution, logos, signatures, copyright information, or identifying marks and then reposted as original content belonging to another person or organization.
Permission to repost does not include permission to sell, reproduce commercially, manufacture merchandise from, license, or distribute the graphic as a standalone digital product.
COMMERCIAL USE AND LICENSING
Anyone wishing to use an Ocean's Haven quote, design, graphic, written work, or other protected material for commercial purposes must obtain prior written authorization from Ocean's Haven.
Commercial licensing, when available, may be subject to separate terms and licensing fees.
No commercial license is granted merely by purchasing an Ocean's Haven product, following an Ocean's Haven social media account, sharing an Ocean's Haven post, or accessing publicly available content.
TRADEMARKS AND BRAND IDENTIFIERS
Names, logos, slogans, program names, collection names, product names, and other brand identifiers used by Ocean's Haven, Bianca Ocean Desmore, and/or Ocean~Spirithealer—including those displayed with the ™ symbol—may constitute trademarks or other protected brand identifiers.
Such marks may not be used in a manner that falsely implies sponsorship, affiliation, endorsement, ownership, or authorization by Ocean's Haven.
Purchase of merchandise or digital products does not grant a license to commercially use Ocean's Haven trademarks or branding.
RESERVATION OF RIGHTS
Except for the limited personal sharing permission expressly provided above, all rights are reserved.
Nothing in these Terms should be interpreted as transferring ownership of Ocean's Haven intellectual property or granting a license beyond the limited permissions expressly stated.
PERSONAL USE OF EDUCATIONAL AND WELLNESS MATERIALS
Unless specifically stated otherwise, Ocean's Haven workbooks, educational materials, meditations, courses, assessments, and related resources are provided for personal educational, informational, or self-development purposes.
They are not a substitute for professional medical, psychological, legal, financial, or other licensed professional services.
No particular personal, financial, emotional, health, or other outcome is guaranteed from purchasing or using these materials.
PROMOTIONAL AND CHARITABLE CONTRIBUTIONS
When Ocean's Haven states that a portion of sales from a particular product, collection, or promotion will benefit an organization, initiative, or cause, the applicable product description or promotion will identify the contribution.
Unless specifically stated otherwise, purchasing a product does not make the customer a direct donor to the recipient organization and should not be treated by the customer as a charitable contribution or tax-deductible donation.
WEBSITE USE
You agree not to misuse OceansHaven.org, interfere with its operation, attempt unauthorized access to the website or its systems, use the website for unlawful purposes, or reproduce protected website content without authorization.
LIMITATION OF LIABILITY
To the extent permitted by applicable law, Ocean's Haven will not be liable for indirect, incidental, special, or consequential damages arising from use of the website, products, or services.
Nothing in these Terms & Conditions excludes or limits liability or consumer rights that cannot legally be excluded or limited.
REFUNDS AND RETURNS
Refunds, replacements, exchanges, damaged merchandise, lost packages, digital purchases, and other purchase-related remedies are governed by the Ocean's Haven Refund & Return Policy.
Because the store sells different types of products, different refund rules apply to made-to-order physical merchandise and digital products.
Customers should review that policy before purchasing.
PRIVACY
Use of personal information collected through OceansHaven.org is governed by the Ocean's Haven Privacy Policy.
CHANGES TO THESE TERMS
Ocean's Haven may update these Terms & Conditions when our products, services, business practices, or legal requirements change.
The most current version will be posted on OceansHaven.org with an updated effective date.
GOVERNING LAW
These Terms & Conditions are governed by applicable laws of the State of North Carolina and applicable federal laws of the United States, without limiting any consumer rights that must apply under another jurisdiction's laws.
